TERMS & CONDITIONS OF USE of the National Electronic Health Record Web Portal
Navigation and browsing of the National Electronic Health Record Web Portal, hosted under the domain name “https://ehealthrecord.gov.gr”, as well as the specific services provided to its users, are subject to the following terms of use:
- The present website contains data and services owned, supervised, or supported by the Ministry of Health, or data and services for which the Ministry of Health has been granted authorization for processing and management.
- Navigation on the National Electronic Health Record Web Portal and use of its specific services implies the user’s unconditional acceptance of these terms of use, as well as any service specific terms, as included herein.
- User navigation on the National Electronic Health Record Web Portal and use of the services provided must be carried out solely for lawful purposes, in a lawful manner, and in accordance with the specific usage guidelines applicable to each service.
- Users of the National Electronic Health Record Web Portal must refrain from any malicious action involving its software and systems, any attempt at unauthorized access to any system or subsystem of the software, and any action that involves attempting to identify or access portal services without the authorized use of access credentials.
- Each user bears exclusive personal responsibility for safeguarding their access credentials. The Ministry of Health shall verify users’ identity data (authentication), similar to the authentication process used for the services of the General Secretariat for Information Systems of Public Administration (taxisnet), without excluding other authentication methods used to create secure structures, based on data obtained—subject to the user’s consent—from third party entities or data of high classification from personal smart devices.
- The Ministry of Health takes all necessary technical and organizational measures to ensure, to the greatest extent possible, the accuracy of the information published on the website and the continuous and uninterrupted operation of its services. However, it cannot guarantee absolute completeness, accuracy, or continuity of operations. Changes to the content of posted information and data on main landing pages or specific software services of the portal may occur at any time without prior notification to users.
- Acceptance of the terms of use, the policies, and the system’s limitations—especially consent or refusal regarding the transmission of personal data, whether special category or not, in accordance with Regulation (EU) 2016/679 (GDPR)—shall take place after user authentication. Consequently, such acceptance cannot, in principle, be disputed, and the user shall bear the burden of proving a system failure, force majeure, or another exceptional reason that prevented the authentication process from being successfully completed for the specific user or their lawfully authorized representative.
- Users are advised to take all necessary measures to protect the integrity and security of their own information systems, hardware, and software, to ensure adequate protection of their portal access data and usage data stored on local storage devices, portable or otherwise. Any malfunction of the user’s systems or data leakage resulting from intrusion by malicious software into the user’s operating system does not exempt the user from their obligations under these terms, nor does it constitute an event of force majeure or exceptional circumstance, nor does it give rise to any liability of the Ministry of Health for any damage the user may suffer.
- Users must have the latest operating system and browser software installed to ensure maximum interoperability with the portal’s software. The portal’s software is structured and designed to interoperate with all browsers and operating systems. Technical limitations may nevertheless occur. This paragraph does not constitute a guarantee of interoperability, as such interoperability depends on each user’s software environment.
- The Web Portal may contain hyperlinks to external websites. These hyperlinks are provided solely for the convenience of users and do not constitute an index of websites whose content has been posted, approved, or adopted in any way by the Ministry of Health.
- The Ministry of Health shall not be liable for any damage (direct or indirect, actual or consequential) that may be suffered by the user of the Web Portal and its services arising from the use or inability to use the portal, from delays during use, or from malfunctions or omissions, regardless of cause—indicatively including failures of telecommunications equipment or internet connection quality—which fall within the sphere of influence of the user or their telecommunications service provider.
- When using the Web Portal’s electronic services, the user must provide exclusively true, accurate, valid, and complete information regarding the data they submit, whether for authentication or for entering free text data or making selections from drop down menus within the portal’s software (such as uploading or creating documents, etc.).
- If a user engages in malicious actions or misuse of the portal’s software or services, in violation of these terms or applicable law, the Ministry of Health reserves the right—beyond taking the necessary actions to safeguard its legal rights and referring the case to the competent authorities for investigation of possible criminal offenses or administrative violations—to implement temporary protective measures, including disabling the user’s access to the portal. Any request for lifting such restriction or objections thereto shall be reviewed by the General Secretariat for Information Systems of Public Administration.
- In the event of force majeure affecting the operation of the portal, as defined by law and case law, the Ministry of Health reserves the absolute and exclusive right to suspend the operation of the portal and its services for as long as the force majeure event persists, without any liability toward users and without any obligation to notify users in advance.
- This policy—terms of use and its specific sections—shall be deemed fully accepted upon user authentication. Partial or conditional acceptance is not permitted. Any refusal to accept the terms of use requires users to cease all use of the portal (browsing – navigation – logging in to use services).
- A usage guide with descriptions and relevant audiovisual material may be posted for each service. Usage guides do not constitute annexes to these terms and pertain solely to the functional use of the system. The Ministry of Health shall make every effort to update these terms as soon as possible to align them with any new feature or functionality introduced to the portal.
- The Ministry of Health may modify these terms of use, in whole or in part, at its sole discretion. Each newly codified and amended version shall take immediate effect upon publication, without any further requirement for notice or adherence to deadlines or special procedures.
- If any provision or provisions herein are deemed invalid, such invalidity shall apply only to those specific provisions and shall not affect the validity of the remaining terms.
- For any dispute arising from the application of these terms or from the use of the portal, exclusive jurisdiction shall lie with the Courts of Athens.
